A key pillar of APDU’s Guiding Principles for Public Data is that Privacy and Confidentiality Are Protected. We all expect the federal government to treat us fairly and safeguard our personal information. And, in fact, there are multiple federal laws designed to ensure that the government does so. One common theme across these laws is that strong privacy protections require managing data according to Fair Information Principles.

These laws and requirements are a confusing patchwork, filled with exceptions, specific rules, and loopholes.

The Privacy Act of 1974 is the foundational federal privacy law, providing guardrails for when and how personal data is handled and shared by the federal government. But the rules can be complex. They are frequently misunderstood and are susceptible to exploitation and twisting.
